If agreed at heads of terms stage, a schedule of condition usually takes place before the start of a lease. They determine the condition of a building and highlight any defects. These are important because it can be used as evidence at the end of a lease. It clearly identifies who is liable for what damages, so the tenant and landlord only has liabilities they are responsible for.

 

When negotiating dilapidations having a schedule of condition in place helps protect tenants, especially when the premises being taking are not in good condition. Having a detailed schedule often simplifies negotiations, allowing for a fair and quick resolution and it’s important to make sure the schedule is carried out thoroughly to not miss any defects. We have seen many examples of tenants being hit unfairly by landlords wanting the condition of the premises handed back in a far greater condition from when the lease started, it’s therefore advisable for tenants to request that this considered for in the lease.
