It is often important to first establish if the lease is held within the security of tenure provisions of the Landlord and Tenant Act 1954. The Act was created to provide security of tenure to business tenants. If the Act applies the relevant business tenancy will not automatically end upon expiry of the contractual term of a lease, if the tenant remains in occupation for the purposes of a business. Invariably a notice needs to be served by either the landlord or tenant. It is essential these are served at the correct time to protect the position of the parties.
When it comes to lease renewal negotiation its often best to consider your options well in advance of the lease expiry date; particularly when the lease is outside The Act and no lease security exists as at the date of expiry. For tenants we can advise on alternative properties which may also assist with the negotiation of the lease renewal and helping to fully consider all the options available. For landlords we can consider the marketing options for your property where it looks likely that the tenant will not renew their existing lease.
